One dead and one missing in San Francisco boat accident

Two sailors vanished in the San Francisco Bay with their boat Daisy after racing in the Golden Gate Yacht Club Charity Race.

Authorities realized there was a San Francisco boat accident after the other three-dozen boats competing in the race returned to the San Francisco port.

According to the San Francisco Chronicle, boat debris and the body of one of the missing sailors was pulled out of the water at Moss Beach, while the other sailor remains missing. Officials say anything from equipment failure to problems with the challenging conditions of the water could have caused the San Francisco boat accident.

The Coast Guard has ended the search for the missing sailor due to the unlikelihood of his survival.

Doctors cleared in California wrongful death case

A county jury cleared the cardiologist and radiologist of negligence in the diagnosis and treatment of actor John Ritter in the California wrongful death lawsuit, according to The Associated Press. The actor died in September of 2003 from an aortic tear.

John Ritter’s widow and children filed the California wrongful death lawsuit, claiming his death was brought about by a “rushed, faulty diagnosis.” The family said the doctors, accused in the wrongful death case, failed to give Ritter an x-ray that would have revealed the torn aorta and his immediate need for surgery. The defense argued the surgery wouldn’t have changed the outcome of the situation.

A 9 -3 verdict declared there was no judgment damage against the doctors involved with the actor’s death.

Millions of bees escape in California truck accident

The Associated Press reported that a tractor-trailer flipped over on Highway 99 in Sacramento, California.

The truck traveling to Washington was carrying a complete load of bee crates filled with the swarming insects that were to be used for pollination purposes in the San Joaquin Valley when the California truck accident happened. While entering the highway, the truck turned over releasing 8-to-12 million bees.

The truck driver, along with Sacramento police officers and firefighters, were stung several times while trying to clear the scene of the California truck accident.

Amgen, J&J Anemia Drugs Tied to Deaths, FDA Says

The California-based Amgen pharmaceutical company is in the news lately because its anemia drug, in addition to Johnson & Johnson’s competing drug, have been found to increase the risk of death in some patients and may result in faster-spreading tumors in cancer patients.

Amgen’s drug Aranesp and Johnson & Johnson’s Procrit may be particularly dangerous for patients with cancers of the breast, head and neck, lung, and cervix. There are many California drug injuries every year, but the notion of taking a drug that exacerbates the spreading of cancer is particularly terrifying as the drugs are designed to treat anemia, a side-effect of chemotherapy.

Supreme Court ruling could have serious consequences for injured victims

The Supreme Court recently handed down a ruling regarding defective medical devices that may have serious ramification for the victims of California defective medical product injuries. A California defective medical device injury can be life-altering and extremely painful; injuries suffered from devices that were negligently manufactured—such as an artificial hip implant laden with bacteria or a painkiller patch that leaks and exposes users to harmful levels of dangerous drugs—can even result in death.

The Supreme Court ruled that a medical device manufacturer, despite if one of their devices is later proven to be defective, is not liable for damages to a harmed individual if the device was originally approved by the Food and Drug Administration (FDA). This ruling comes as a huge surprise to most Americans, who expect our courts to be able to help us if we fall victim to a California defective medical device injury.
